Personal data protection
Pursuant to art. 13 of the General Data Protection Regulation of 27 April 2016 (OJ L 119 of 04/05/2016), please be informed that:
1. The Controller of the Client’s personal data is W. LEGUTKO Przedsiębiorstwo Hodowlano – Nasienne Spółka z ograniczoną odpowiedzialnością with its registered office at 63-930 Jutrosin, Nad Stawem 1F, registered in the District Court Poznań – Nowe Miasto and Wilda in Poznań, 9th Commercial Division of the National Court Register under KRS no. 0000504100, NIP [Tax Id No.]: 6991955297 with share capital of PLN 29,700,000.00.
2. The Client’s personal data will be processed by W. LEGUTKO Przedsiębiorstwo Hodowlano – Nasienne Spółka z ograniczoną odpowiedzialnością in accordance with generally applicable regulations (including: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC – hereinafter called the GDPR) – for the period of carrying out activities aimed at achieving the purposes for which it was collected.
3. W. LEGUTKO Przedsiębiorstwo Hodowlano – Nasienne Spółka z ograniczoną odpowiedzialnością processes personal data of its Clients in order to:
a) perform the contracts for the provision of electronic services, sales contracts or other contracts concluded on the terms set out in these Regulations – in particular in connection with Account registration or placing orders. The basis for processing in this case is the performance of the contract with the Client or taking action at the request of the Client before concluding the contract (art. 6(1)(b) of the GDPR).
b) fulfil legal obligations of W. LEGUTKO Przedsiębiorstwo Hodowlano – Nasienne Spółka z ograniczoną odpowiedzialnością, in particular in the scope of keeping proper accounting records (art. 6(1)(c) of the GDPR).
c) promote own goods or services, as well as to create statements, analyses, and statistics as well as pursuing claims. The basis for processing in this case is the legitimate interest of W. LEGUTKO Przedsiębiorstwo Hodowlano – Nasienne Spółka z ograniczoną odpowiedzialnością (art. 6(1)(f) of the GDPR).
4. Within the limits indicated above, W. LEGUTKO Przedsiębiorstwo Hodowlano – Nasienne Spółka z ograniczoną odpowiedzialnością may process data using profiling techniques assuming automated decision making. The purpose of such profiling will be to best match the content provided to the Client – including displayed advertisements – to the needs and interests of that Client, based on the available demographic and behavioural data. In the event that an automated decision has legal effects on the Client or similarly significantly affects the Client, W. LEGUTKO Przedsiębiorstwo Hodowlano – Nasienne Spółka z ograniczoną odpowiedzialnością will process the data only with the Client’s consent (art. 6(1)(a) of the GDPR).
5. In each case, the disclosure of personal data by the Client is voluntary – with the reservation that some data is necessary for W. LEGUTKO Przedsiębiorstwo Hodowlano – Nasienne Spółka z ograniczoną odpowiedzialnością to perform the sales contract concluded via the platform.
6. Client’s personal data may be transferred to third parties only for the purpose and when W. LEGUTKO Przedsiębiorstwo Hodowlano – Nasienne Spółka z ograniczoną odpowiedzialnością is entitled or obliged to do so under applicable law. Data recipients may include in particular: persons operating infrastructure or IT systems, subcontractors, persons providing services related to the performance or improvement of the sales process (e.g. payment intermediaries, banks, advertising agencies, couriers or carriers), as well as advisors (e.g. in the field of accounting or legal service) or auditors.
7. The Client has the right to access his/her personal data, rectify it, delete or limit its processing, and the right to object to the processing, as well as the right to transfer the data. The Client has the right to object, especially if there is no basis for data processing or if the data is processed for direct marketing purposes.
8. In the event that the processing takes place in violation of the law, the Client has the right to lodge a complaint with the supervisory body.
